Sainsbury & Wilson } Contract for Sale & Purchase

Conditions of Sale of a house and orchard situate in
the borough of Berkeley in the County of Gloucester
containing about one acre in the occupation of
Mr Robert Wilson to be sold by auction at the
Berkeley Arms Inn Berkeley on Tuesday
September 17th 1838.

First. That the highest bidder shall be the purchaser and
if any doubt arise with respect to who was the highest or
last bidder, the premises shall be put up again at the
last price on bidding, next preceeding that under dispute.?

Second. That no person shall advance less than two pounds at
any one bidding, or retract this other biddings after
or? has been ??? by the auctioneer.

Third. That the purchaser shall immediatley pay into the
hands of the auctioneer a deposit, on this ??? ???
??? money, after the rate? of 10£ ???, and also
at the same time sign an agreement for payment
of the remainder therof to the proprietor of this order
at the office of Mr H Vigards &co solicitors on the eigth day of
October next, at which time and place the purchase
is to be completed and the purchaser shall be entitled
to the renst and profits of the premises from that day
and to have possession of the said premises on the
twenty fifth day of march next, but the premises to
remain at the risk of the purchaser from the day
of sale or to ??? and all other casualties.

Fourth. That the auction duty of seven pence in the pound
shall immediatley after the sale be paid to the auctioner
by the purchaser with one ginuea for his trouble for
selling and the like fee for the contract.

Fifth. That the vendor shall ??? and deliver at his own
expence on or before (the twenty fourth) instant
an abstract of this title to the purchaser and shall
deduce? a good title thereto.
