Sixth. That upon payment of the remainder of the purchase
money at this time and place above mentioned
the vendor sha;; execute a proper conveyance
to the purchaser to be prepared at his ??? own
expence, upon the same being tendered for that
purpose

Seventh. That in ??? a good title, such as shall be approved by council, cannot be made out to the premises, the
deposit money and duty paid to government shall
be returned to the purchaser, who shall accept the
same in full satisfaction and discharge of all
demages and demands whatsoever.

Eigth. That all assignments or surrenders of mortgage or
other terms not already assigned to attend the fee
shall be prepared by and at the offence of the vendor
but where the same terms have been once assigned
such assignments and surrender respectively, shall be
made at the expence of the purchaser.

Ninth. That if any mistake or omission be made in the
description or particulars, of the premises, such mistake
or omission shall not ?? the sale, but the vendor or purchaser
as the case may be shall pay or allow a ???tionale
sum then the same to be ascertained by two
indifferent persons, one to be chosen by each party
within ten days after the discovery of such mistake
or ommission and notice therof given to the other
parties, which two persons shall be at liberty to
chose an umpire? before they enter upon business and
the decision of such referees or umpires as the ??? may be
shall be final.

Tenth. That f the purchaser shall fail to comply with the
above conditions his or her deposit money shall be
forfeited to the vendor, who shall be at liberty to resell
the premises either by public auction or private contract.
